*** UPDATED - 14/2/17 ***
Please note any forms returned for further action are uploaded to the case together with the covering letter as well as being posted/emailed. Please check the case documents section, if a case has not been updated with a form as expected.
For trust deeds signed on or after 28 November 2013, please remember to submit your Form 6 to AiB at the same time you are applying to creditors for your discharge. The system will not accept any Form 7s where the trustee's discharge date is before the Form 6 submitted date.
DEAR TRUSTEE LETTER - NON-REALISATION OF EQUITY
Please refer to the Dear Trustee letter dated 29/11/16, regarding the requirement of notes on the Form 3 presented to creditors, where the trustee does not propose to realise equity in full.
For trust deeds signed on or after 5/1/17, failure to provide the required information on the Form 3 could result in the trust deed not becoming protected and having to be re-advertised with a new Form 3 issued to creditors.
Dear Trustee letter dated 14 July 2016 also applies.
PROTECTED TRUST DEEDS (SCOTLAND) AMENDMENT REGULATIONS 2016
Please remember to refer to the amendment regulations and use the correct forms for any trust deeds signed on or after 28 November 2013 when submitting Forms 4, 5, 6 and 7.
Any forms submitted on the incorrect statutory form will be returned for amendment.
The latest edition of the PTD Bulletin has been published on the AiB website:
FORM 5 SUBMISSIONS
It would be helpful when you are submitting a Form 5 under the Protected Trust Deed (Scotland) Regulations 2013 before an agreed payment period expires, if you could also provide supporting information as to why you are applying for the debtor's discharge. i.e Further asset realisations have allowed creditors to be paid in full. This will save any delay in us approving the discharge.
